1. Parties to the Agreement

This agreement is between Engutoto Pte Ltd, a company incorporated in Singapore (“we”, “us”, “our”), and you (“you” or “your”), the customer booking travel services through our platform.

2. Nature of Our Services

Engutoto Pte Ltd provides a digital platform for discovering and booking curated travel experiences in East Africa. We connect you with independently operated tour providers and accommodation partners (“Travel Providers”).

We do not own, manage, or operate the tours, accommodation, transport, or experiences offered. We do not assume liability for the actual provision of travel services, which are delivered by the Travel Providers under their own terms and conditions.

3. Booking and Payment

By booking through our platform, you authorize Engutoto Pte Ltd to process payments for the travel services you have selected. Your booking is facilitated on behalf of the Travel Provider, who is the actual supplier of the services.

We deduct a facilitation or booking fee from your payment, and the balance is remitted to the relevant Travel Provider. In some cases, we may act on behalf of multiple parties or facilitate B2B bookings for travel agencies and intermediaries.

4. Contracts with Travel Providers

Upon booking confirmation, a separate contract is formed between you and the Travel Provider. Their individual terms and conditions, including cancellation and refund policies, will apply to your booking. Engutoto Pte Ltd is not a party to this service contract.

5. Limitation of Liability

Engutoto Pte Ltd is not responsible for the delivery, quality, or performance of travel services. All travel services are provided by independent Travel Providers under separate agreements.

We take care to work with vetted and insured operators who meet our quality standards and local licensing requirements. However, as travel involves inherent risks, we strongly recommend that all travellers obtain comprehensive personal travel insurance, including coverage for cancellations, delays, medical emergencies, and personal belongings.

Any complaints or disputes relating to the travel experience itself should be addressed directly to the relevant Travel Provider.

6. Cancellations and Modifications

Engutoto Pte Ltd facilitates cancellation or modification requests in accordance with the policies of the Travel Providers. Our facilitation fee may be non-refundable depending on the nature and timing of the cancellation.

7. Role Clarification

Engutoto Pte Ltd acts solely as a marketing and booking facilitator, not as a tour operator, service provider, or travel agent. We do not guarantee or insure the performance of any third-party travel services, nor do we accept liability for the acts or omissions of Travel Providers.
