Engutoto Pte Ltd — Terms & Conditions

These Terms & Conditions (“T&Cs”) apply to all users, quotes, bookings, and services facilitated by Engutoto Pte Ltd (“Engutoto”, “we”, “us”). By making a booking or paying a deposit, you (“you”, “traveler”, “client”) agree to these T&Cs on behalf of all persons in your booking.

1. Platform Role & Services

1.1 Engutoto is a travel marketplace / booking platform connecting clients with safari / lodge / activity suppliers (e.g. Simba Safaris).
1.2 We do not directly provide the actual safari services; those are provided by third-party Suppliers under their own terms.
1.3 Where we act as agent, the terms of the Supplier apply for the portion of the services they provide.
1.4 These T&Cs govern your use of the platform, bookings, payments, cancellations, and disputes between you and Engutoto or Suppliers.

2. Quotes, Prices & Confirmations

2.1 You may request a quote through Engutoto. Quotes are valid only for the period stated and subject to availability.
2.2 All prices are indicative until confirmed. Final pricing may include surcharges due to currency fluctuations, park fees, or Supplier changes.
2.3 Once Engutoto issues a confirmation and invoice, a binding booking is created between you and Engutoto (and by extension the Supplier under its terms).

3. Deposits & Payment Schedule

3.1 To secure a booking, you must pay a 50% deposit within 10 business days of confirmation.
3.2 The remaining balance (50%) must be fully paid 60 days before the safari start date.
3.3 If booking is made within 60 days of departure, full payment is due at confirmation.
3.4 In the event of non-payment by the deadlines, Engutoto may treat the booking as cancelled and retain any funds to cover Supplier commitments, booking fees and administrative costs.

4. Payment Methods & Charges

4.1 We accept payments via:

  • Credit / debit cards (Visa, Mastercard, Amex) via Stripe

  • Bank transfers (EFT / SWIFT) in SGD, USD, EUR, GBP

4.2 All payments must be made free of bank or intermediary charges. You bear any transfer costs so that the full quoted amount is received.
4.3 Refunds, when applicable, will be processed in the original payment currency, minus any non-refundable processing or bank fees.

5. Changes / Modifications

5.1 By You: Minor corrections (names, contact info) can be made free within 10 days of confirmation. Major changes (dates, route, accommodation) are subject to availability, Supplier fees, and an admin fee (e.g. USD / EUR / GBP 150), plus any difference in cost.
5.2 By Suppliers: Suppliers may need to adjust itineraries, accommodations, or services due to practical, safety, or operational reasons. In case of a major change, you may accept an alternative, rebook, or cancel with refund of recoverable amounts (less non-refundable costs).

6. Cancellation & Refunds

6.1 Cancellation by You:

  • ≥ 60 days prior: 50% deposit is non-refundable.

  • Between 0 and 59 days: 100% of total cost chargeable.

6.2 Cancellation by Supplier / Engutoto:
If the Supplier cancels (for reasons beyond control), we will strive to provide alternatives or refund what is recoverable (less non-refundable portions), there may be a change in cost if a different operator is used.
Refunds exclude Supplier non-refundable deposits and service fees already rendered.

7. Liability & Risk

7.1 You acknowledge safaris and adventures carry inherent risks (wildlife, terrain, weather, logistic delays). You assume those risks and must follow all safety instructions.
7.2 Engutoto is not liable for failures or defaults by Suppliers.
7.3 We do not accept responsibility for indirect, consequential, or business losses.
7.4 Our liability to you (if proven) is limited to the amounts you paid to Engutoto (excluding amounts passed on to Suppliers or external fees).

8. Insurance

Comprehensive travel insurance (medical, evacuation, cancellation, baggage) is required. You should present proof of insurance when requested.

9. Health, Visas & Compliance

You are responsible for all travel documents (passport, visas), vaccinations, health requirements, and compliance with destination laws and regulations. Engutoto is not liable for costs arising from non-compliance.

10. Complaints

Issues during your trip should be raised immediately with the Supplier/guide and to Engutoto. Formal complaints must be submitted in writing within 28 days after trip completion, with supporting evidence.

11. Force Majeure

Neither Engutoto nor Suppliers are liable for failure or delays caused by events outside reasonable control (natural disasters, government actions, epidemics, strikes, etc.). Refunds in such cases are limited to recoverable amounts from Suppliers.

12. Governing Law & Jurisdiction

These T&Cs are governed by Singapore law for Engutoto’s platform services. For the actual safari / service provisions by Suppliers, local law and courts apply as per Supplier terms.

13. Acceptance & Binding Nature

By paying deposit or completing booking, you confirm you have read, understood and accepted these T&Cs and the applicable Supplier’s terms.
